CONDIÇÕES GERAIS DE CONTRATO DA CANYON BICYCLES GMBH
(1) Todas as ofertas, contratos de compra, fornecimentos e serviços em resultado de encomendas por parte dos nossos clientes através da nossa loja online www.canyon.com, (doravante designada “webshop”), incluindo encomendas por telefone, e-mail, fax ou correio, estão sujeitas a estas Condições Gerais de Contrato. Estas Condições Gerais de Contrato aplicam-se ainda a vendas no nosso showroom, desde que os regulamentos seguintes não se dirijam especificamente à venda à distância.
(2) A oferta de produtos na nossa webshop dirige-se igualmente a consumidores e empresas, mas apenas a clientes finais. Para efeitos destas Condições Gerais de Contrato, considera-se que (i) um consumidor é qualquer pessoa singular que assina um contrato para um determinado fim, o qual não se destina à sua actividade económica ou profissional independente (§ 13 do Código Civil alemão – BGB) e que (ii) uma “empresa” é uma pessoa singular ou jurídica, ou ainda uma sociedade com capacidade legal que, aquando da conclusão do contrato, está a exercer a sua actividade económica ou profissional independente (§ 14 al. 1 BGB).
(3) Não se aplicam aqui as condições comerciais do cliente, mesmo que sejam ou não postas em causa a sua validade em casos individuais.
(1) As nossas ofertas na webshop, em catálogos e no nosso showroom não são vinculativas.
(2) Ao proceder a uma encomenda na webshop (a qual exige o registo prévio e aceitação destas Condições Gerais de Contrato), o cliente faz uma oferta vinculativa para a compra do produto em questão. O cliente está vinculado à oferta durante os 5 dias seguintes à data da oferta. Estamos autorizados a assumir a oferta neste período de tempo.
(3) Iremos enviar ao cliente, imediatamente após a entrada da oferta, uma confirmação sobre a recepção da oferta, a qual não implica a aceitação da mesma. A oferta é considerada assumida por nós apenas quando informamos explicitamente o cliente (por e-mail) da aceitação ou enviarmos o produto. O contrato de compra com o cliente só é validado com a nossa aceitação.
(4) Qualquer cliente, o qual é consumidor, está autorizado a cancelar a oferta de acordo com a política de resolução e devolução, a qual lhe é fornecida em conjunto com a confirmação sobre a recepção da oferta, e devolver o produto.
(5) No caso do cliente solicitar um orçamento para serviços de reparação, de forma a evitar tempos de imobilização desnecessariamente prolongados das bicicletas, o cliente deverá declarar no espaço de duas semanas a partir da recepção do orçamento solicitado, se aceita ou recusa a nossa oferta. Se o cliente não responder no espaço de duas semanas, ao mesmo é atribuído um prazo posterior de uma semana.Se o cliente não der qualquer resposta dentro deste prazo, assumiremos que o cliente recusou a nossa oferta e devolvemos-lhe o produto, estando os custos a cargo do cliente. O cliente será novamente informado sobre o estabelecimento de novo prazo.
(1) Os preços mencionados incluem IVA à taxa legal em vigor (PVP), não incluindo os custos de envio. Os preços para países fora da UE (com exclusão da Austrália e Nova Zelândia) não incluem IVA. Qualquer imposto aduaneiro e encargos públicos são suportados pelo Cliente.
(2) Salvo acordo expresso em contrário, o fornecimento é feito apenas após pagamento ter sido efetuado (de acordo com o indicado no formulário de encomenda) mediante receção da fatura (a qual pode ser enviada por e-mail ou incluída na nossa aceitação). A pedido do cliente, o qual deverá ser indicado no formulário de encomenda, fornecemos o produto contra pagamento do montante da fatura, nas nossas instalações em Karl-Tesche-Straße 12, D-56073 Koblenz.
(3) O cliente não tem direito à compensação ou retenção desde que o pedido reconvencional seja indisputável ou tenha sido estabelecido por lei.
(1) Enviaremos o produto ao cliente antes ou no prazo indicado para despacho (por exemplo, data em que o produto é entregue por nós ao expedidor), conforme mencionado na página de disponbilide no momento da encomenda, embora se trate apenas de uma data aproximada, podendo ser ultrapassada em dois dias úteis. Se não tiver sido indicado qualquer prazo de envio, os produtos classificados como “DISPONÍVEL DE IMEDIATO” serão enviados o mais tardar no quinto dia útil (sujeito a uma venda permitida de acordo com a alínea 2), e todos os outros produtos no espaço de três semanas. Este prazo, aplicável para a determinação da data de envio, tem início no dia da recepção do montante total de compra (incluindo IVA e custos de envio).
(2) Se o produto estiver classificado como “DISPONÍVEL DE IMEDIATO” na webshop no momento de submeter a encomenda, manteremos o produto em armazém no espaço de cinco dias úteis após a nossa aceitação; se o pagamento não for feito dentro deste prazo, estamos autorizados a vender o produto a qualquer momento. Neste caso, o envio é feito apenas dentro deste prazo de cinco dias úteis se o stock for suficiente. Caso contrário, o prazo de envio de três semanas a partir da recepção do pagamento é tido como acordado.
(3) No caso em que o nosso fornecedor não nos envia atempadamente o produto, o qual não foi classificado pelo cliente como “DISPONÍVEL DE IMEDIATO” aquando da encomenda na página da oferta na webshop ou foi liquidado de acordo com a alínea 2 , o prazo aplicável de acordo com a alínea 1 e 2 estende-se até ao fornecimento pelo nosso fornecedor para mais dois dias úteis ou, o mais tardar, três semanas. Este prolongamento do prazo constitui o pressuposto de que encomendámos o produto atempadamente e que o atraso no fornecimento por parte do nosso fornecedor não é da nossa responsabilidade.
(4) Se um produto não puder ser fornecido atempadamente devido aos motivos mencionados na alínea 3, tal será comprovado de imediato perante o cliente. Nestes casos, iremos estabelecer um acordo individual com o cliente relativamente ao prazo de fornecimento. Se o produto não estiver disponível junto do nosso fornecedor num futuro próximo, temos o direito de anular o contrato de compra. Em caso de anulação, iremos reembolsar de imediato o cliente pelos pagamentos efectuados. Os direitos legais do cliente associados ao atraso no fornecimento não são contemplados pela presente regulamentação, ao passo que o cliente pode exigir uma indemnização apenas de acordo com o número 8 destas Condições Gerais de Contrato. Se o produto não puder ser permanentemente fornecido, prescindimos de uma declaração de aceitação. Neste caso, não é feito qualquer contrato.
(5) Se não pudermos cumprir um prazo de entrega, o cliente deverá definir um novo prazo, o qual não deverá ser inferior a uma semana.
(6) Temos o direito de proceder a entregas parciais de produtos incluídos na mesma encomenda, sendo que os custos de envio resultantes estão a nosso cargo.
(7) Se tiver sido acordado um prazo de levantamento com o cliente e o cliente não cumprir o prazo, estabeleceremos um novo prazo de uma semana. No final deste prazo, reservamo-nos o direito de anular o contrato. Informaremos novamente o cliente sobre o estabelecimento de novo prazo.
(1) As bicicletas Canyon são totalmente montadas e ajustadas por técnicos qualificados na nossa fábrica. Os componentes específicos (rodas, espigão e selim, pedais e guiador) são removidos por questões de segurança antes da expedição. Por este motivo, o consumidor deve encaixar estas partes após receber a bicicleta. Juntamente com a bicicleta é enviada informação sobre como colocar as rodas, espigão e selim, pedais e guiador, bem como as ferramentas necessárias para o fazer. (2) Salvo acordo expresso em contrário, definimos o tipo de envio e a empresa transportadora de acordo com a nossa apreciação. Assumimos o risco de envio quando cliente é o consumidor.
(3) Assumimos apenas o envio atempado e correcto do produto à empresa transportadora e não nos responsabilizamos pelos atrasos provocados pela empresa transportadora. Uma duração de envio mencionada na nossa webshop não é por isso vinculativa.
(4) Se o cliente for o consumidor, o perigo de destruição acidental, de danos acidentais ou da perda acidental do produto fornecido recai sobre o cliente no momento em que o produto é enviado ao cliente ou o cliente entre em atraso na aceitação. Em todos os restantes casos, o perigo resultante da expedição do produto para a nossa empresa transportadora recai sobre o cliente.
(5) Os custos de envio são da responsabilidade do comprador. Os mesmos incluem os custos do seguro contra riscos de transporte. Os respectivos custos de envio são indicados ao cliente no formulário de encomenda.
(6) O cliente deverá assumir os custos da devolução em caso de resolução do contrato quando o produto fornecido corresponde ao encomendado e quando o preço da mercadoria devolvida não ultrapassa um montante de 40 EUR ou quando o cliente, sendo o valor superior, na altura da resolução do contrato, não tenha ainda efectuado o pagamento na totalidade ou um pagamento parcial estabelecido por acordo.
(1) Reservamo-nos o direito ao produto fornecido por nós até ao pagamento na totalidade do preço de compra (incluindo IVA e custos de envio) do produto em questão.
(1) Se o produto fornecido apresentar um defeito, o cliente pode exigir-nos a eliminação do defeito ou o fornecimento de um produto sem defeitos.
(2) Temos o direito de negar o tipo de desempenho seleccionado pelo comprador quando este só pode ser executado mediante custos desproporcionados.
(3) Se o desempenho subsequente não estiver disponível de acordo com o número 7 ou for inapropriado para o cliente ou até mesmo se recusarmos o desempenho subsequente, o cliente tem o direito de, de acordo com a lei aplicável, abdicar do contrato de compra, reduzir o preço de compra ou exigir uma indemnização ou compensação pela despesa. Para as exigências de indemnização do cliente aplicam-se ainda as determinações especiais do número 8 destas Condições Gerais de Contrato.
(4) A garantia legal é válida durante dois anos a contar da data de entrega. No caso de mercadorias usadas que tenham sido examinadas ou acondicionados, de acordo com as especificações do fabricante, a garantia legal é válida pelo período de um ano.
(5) Para além da garantia legal, oferecemos aos nossos clientes, a partir do ano de modelo de 2008, uma garantia total de 6 anos a partir da data de entrega (5 anos para modelos anteriores a 2008) para quadros Canyon, forquetas Canyon das bicicletas de corrida e de triatlo, bem como para quadros de bicicleta de montanha, com excepção de rolamentos e braços de suspensão, bem como danos na pintura/anodização.
(6) Se não houver restrição dos direitos de garantia do cliente, aplicam-se à nossa garantia as seguintes condições adicionais:
(i) A garantia não se aplica a danos resultantes de uma utilização incorrecta ou inadequada de acordo com as áreas de aplicação apresentadas no nosso website para o respectivo produto, tal como

(4) As restrições do número 8 não se aplicam à nossa responsabilidade por características de qualidade de acordo com o § 444 do BGB, devido a perigo de morte, perigo físico ou ao nível da saúde, ou nos termos do disposto da lei relativa à responsabilidade pelos produtos.

CONDIÇÕES GERAIS DE CONTRATO DA CANYON BICYCLES GMBH
(1) Todas as ofertas, contratos de compra, fornecimentos e serviços em resultado de encomendas por parte dos nossos clientes através da nossa loja online www.canyon.com, (doravante designada “webshop”), incluindo encomendas por telefone, e-mail, fax ou correio, estão sujeitas a estas Condições Gerais de Contrato. Estas Condições Gerais de Contrato aplicam-se ainda a vendas no nosso showroom, desde que os regulamentos seguintes não se dirijam especificamente à venda à distância.
(2) A oferta de produtos na nossa webshop dirige-se igualmente a consumidores e empresas, mas apenas a clientes finais. Para efeitos destas Condições Gerais de Contrato, considera-se que (i) um consumidor é qualquer pessoa singular que assina um contrato para um determinado fim, o qual não se destina à sua actividade económica ou profissional independente (§ 13 do Código Civil alemão – BGB) e que (ii) uma “empresa” é uma pessoa singular ou jurídica, ou ainda uma sociedade com capacidade legal que, aquando da conclusão do contrato, está a exercer a sua actividade económica ou profissional independente (§ 14 al. 1 BGB).
(3) Não se aplicam aqui as condições comerciais do cliente, mesmo que sejam ou não postas em causa a sua validade em casos individuais.

(2) Ao proceder a uma encomenda na webshop (a qual exige o registo prévio e aceitação destas Condições Gerais de Contrato), o cliente faz uma oferta vinculativa para a compra do produto em questão. O cliente está vinculado à oferta durante os 5 dias seguintes à data da oferta. Estamos autorizados a assumir a oferta neste período de tempo.
(3) Iremos enviar ao cliente, imediatamente após a entrada da oferta, uma confirmação sobre a recepção da oferta, a qual não implica a aceitação da mesma. A oferta é considerada assumida por nós apenas quando informamos explicitamente o cliente (por e-mail) da aceitação ou enviarmos o produto. O contrato de compra com o cliente só é validado com a nossa aceitação.
(4) Qualquer cliente, o qual é consumidor, está autorizado a cancelar a oferta de acordo com a política de resolução e devolução, a qual lhe é fornecida em conjunto com a confirmação sobre a recepção da oferta, e devolver o produto.
(5) No caso do cliente solicitar um orçamento para serviços de reparação, de forma a evitar tempos de imobilização desnecessariamente prolongados das bicicletas, o cliente deverá declarar no espaço de duas semanas a partir da recepção do orçamento solicitado, se aceita ou recusa a nossa oferta. Se o cliente não responder no espaço de duas semanas, ao mesmo é atribuído um prazo posterior de uma semana.Se o cliente não der qualquer resposta dentro deste prazo, assumiremos que o cliente recusou a nossa oferta e devolvemos-lhe o produto, estando os custos a cargo do cliente. O cliente será novamente informado sobre o estabelecimento de novo prazo.
(1) Os preços mencionados incluem IVA à taxa legal em vigor (PVP), não incluindo os custos de envio. Os preços para países fora da UE (com exclusão da Austrália e Nova Zelândia) não incluem IVA. Qualquer imposto aduaneiro e encargos públicos são suportados pelo Cliente.
(2) Salvo acordo expresso em contrário, o fornecimento é feito apenas após pagamento ter sido efetuado (de acordo com o indicado no formulário de encomenda) mediante receção da fatura (a qual pode ser enviada por e-mail ou incluída na nossa aceitação). A pedido do cliente, o qual deverá ser indicado no formulário de encomenda, fornecemos o produto contra pagamento do montante da fatura, nas nossas instalações em Karl-Tesche-Straße 12, D-56073 Koblenz.
(3) O cliente não tem direito à compensação ou retenção desde que o pedido reconvencional seja indisputável ou tenha sido estabelecido por lei.
(1) Enviaremos o produto ao cliente antes ou no prazo indicado para despacho (por exemplo, data em que o produto é entregue por nós ao expedidor), conforme mencionado na página de disponbilide no momento da encomenda, embora se trate apenas de uma data aproximada, podendo ser ultrapassada em dois dias úteis. Se não tiver sido indicado qualquer prazo de envio, os produtos classificados como “DISPONÍVEL DE IMEDIATO” serão enviados o mais tardar no quinto dia útil (sujeito a uma venda permitida de acordo com a alínea 2), e todos os outros produtos no espaço de três semanas. Este prazo, aplicável para a determinação da data de envio, tem início no dia da recepção do montante total de compra (incluindo IVA e custos de envio).
(2) Se o produto estiver classificado como “DISPONÍVEL DE IMEDIATO” na webshop no momento de submeter a encomenda, manteremos o produto em armazém no espaço de cinco dias úteis após a nossa aceitação; se o pagamento não for feito dentro deste prazo, estamos autorizados a vender o produto a qualquer momento. Neste caso, o envio é feito apenas dentro deste prazo de cinco dias úteis se o stock for suficiente. Caso contrário, o prazo de envio de três semanas a partir da recepção do pagamento é tido como acordado.
(3) No caso em que o nosso fornecedor não nos envia atempadamente o produto, o qual não foi classificado pelo cliente como “DISPONÍVEL DE IMEDIATO” aquando da encomenda na página da oferta na webshop ou foi liquidado de acordo com a alínea 2 , o prazo aplicável de acordo com a alínea 1 e 2 estende-se até ao fornecimento pelo nosso fornecedor para mais dois dias úteis ou, o mais tardar, três semanas. Este prolongamento do prazo constitui o pressuposto de que encomendámos o produto atempadamente e que o atraso no fornecimento por parte do nosso fornecedor não é da nossa responsabilidade.
(4) Se um produto não puder ser fornecido atempadamente devido aos motivos mencionados na alínea 3, tal será comprovado de imediato perante o cliente. Nestes casos, iremos estabelecer um acordo individual com o cliente relativamente ao prazo de fornecimento. Se o produto não estiver disponível junto do nosso fornecedor num futuro próximo, temos o direito de anular o contrato de compra. Em caso de anulação, iremos reembolsar de imediato o cliente pelos pagamentos efectuados. Os direitos legais do cliente associados ao atraso no fornecimento não são contemplados pela presente regulamentação, ao passo que o cliente pode exigir uma indemnização apenas de acordo com o número 8 destas Condições Gerais de Contrato. Se o produto não puder ser permanentemente fornecido, prescindimos de uma declaração de aceitação. Neste caso, não é feito qualquer contrato.
(5) Se não pudermos cumprir um prazo de entrega, o cliente deverá definir um novo prazo, o qual não deverá ser inferior a uma semana.
(6) Temos o direito de proceder a entregas parciais de produtos incluídos na mesma encomenda, sendo que os custos de envio resultantes estão a nosso cargo.
(7) Se tiver sido acordado um prazo de levantamento com o cliente e o cliente não cumprir o prazo, estabeleceremos um novo prazo de uma semana. No final deste prazo, reservamo-nos o direito de anular o contrato. Informaremos novamente o cliente sobre o estabelecimento de novo prazo.

Os componentes específicos (rodas, espigão e selim, pedais e guiador) são removidos por questões de segurança antes da expedição. (2) Salvo acordo expresso em contrário, definimos o tipo de envio e a empresa transportadora de acordo com a nossa apreciação. Assumimos o risco de envio quando cliente é o consumidor.
(3) Assumimos apenas o envio atempado e correcto do produto à empresa transportadora e não nos responsabilizamos pelos atrasos provocados pela empresa transportadora. Uma duração de envio mencionada na nossa webshop não é por isso vinculativa.
(4) Se o cliente for o consumidor, o perigo de destruição acidental, de danos acidentais ou da perda acidental do produto fornecido recai sobre o cliente no momento em que o produto é enviado ao cliente ou o cliente entre em atraso na aceitação. Em todos os restantes casos, o perigo resultante da expedição do produto para a nossa empresa transportadora recai sobre o cliente.
(5) Os custos de envio são da responsabilidade do comprador. Os mesmos incluem os custos do seguro contra riscos de transporte. Os respectivos custos de envio são indicados ao cliente no formulário de encomenda.
(6) O cliente deverá assumir os custos da devolução em caso de resolução do contrato quando o produto fornecido corresponde ao encomendado e quando o preço da mercadoria devolvida não ultrapassa um montante de 40 EUR ou quando o cliente, sendo o valor superior, na altura da resolução do contrato, não tenha ainda efectuado o pagamento na totalidade ou um pagamento parcial estabelecido por acordo.
(1) Reservamo-nos o direito ao produto fornecido por nós até ao pagamento na totalidade do preço de compra (incluindo IVA e custos de envio) do produto em questão.

Para as exigências de indemnização do cliente aplicam-se ainda as determinações especiais do número 8 destas Condições Gerais de Contrato.
(4) A garantia legal é válida durante dois anos a contar da data de entrega. No caso de mercadorias usadas que tenham sido examinadas ou acondicionados, de acordo com as especificações do fabricante, a garantia legal é válida pelo período de um ano.
(5) Para além da garantia legal, oferecemos aos nossos clientes, a partir do ano de modelo de 2008, uma garantia total de 6 anos a partir da data de entrega (5 anos para modelos anteriores a 2008) para quadros Canyon, forquetas Canyon das bicicletas de corrida e de triatlo, bem como para quadros de bicicleta de montanha, com excepção de rolamentos e braços de suspensão, bem como danos na pintura/anodização.
(6) Se não houver restrição dos direitos de garantia do cliente, aplicam-se à nossa garantia as seguintes condições adicionais:
(i) A garantia não se aplica a danos resultantes de uma utilização incorrecta ou inadequada de acordo com as áreas de aplicação apresentadas no nosso website para o respectivo produto, tal como
